When we act as a data controller

TJ Vehicle Hire is a data controller in respect of telematics data where we determine the purposes and means of processing. For example, we may use the data to manage the hire vehicle, verify mileage, administer billing or investigate misuse of the vehicle.

In this capacity, we are responsible for ensuring the data is processed lawfully and for responding to your data protection rights requests relating to that processing.

When we act as a data processor

Where we collect and pass telematics data to an insurer at their instruction, and the insurer determines why and how that data will be used (for example, for claims handling, risk assessment or fraud investigation relating to their policy), we act as a data processor on the insurer’s behalf.

In this capacity, we process the data strictly in accordance with the insurer’s instructions and a written data processing agreement between us.

The insurer’s role

Our insurer, Flock, is a data controller in respect of any telematics data it receives and uses for its own purposes, including underwriting, claims management, risk pricing and fraud prevention.

As a controller, Flock is separately responsible for complying with data protection law in respect of its processing, including handling data protection rights requests relating to how it uses the data.

Where both parties are independent controllers

In some circumstances, TJ Vehicle Hire and Flock may each independently determine the purposes of processing the same data. For example, we may use the data to manage the hire agreement while Flock separately uses the data to manage the insurance policy.

Where this is the case, each party is an independent controller for its own purposes, and neither is responsible for the other’s compliance.

3. What Data We Collect

While you are driving a vehicle provided by us, a telematics device fitted to the vehicle collects data about how the vehicle is driven and used.

This includes:

• Location data – GPS coordinates, routes travelled, and journey start and end points
• Driving behaviour – speed, acceleration, braking, cornering and idling
• Journey information – time, date and duration of trips, and total mileage
• Vehicle data – diagnostic information such as engine status, fault codes and impact/collision events

4. Why We Collect Telematics Data

We use telematics data to:

• Manage and support the vehicle we have provided to you
• Obtain and provide insurance for the vehicle
• Verify vehicle use, mileage and location for hire administration and billing purposes
• Investigate and support any accident, incident or claim involving the vehicle
• Detect and prevent fraud, theft or misuse of the vehicle

5. Sharing Data with Flock

We share telematics data with Flock, our insurer, so that they can:

• Assess and manage the risk associated with the insurance policy
• Validate the circumstances of an accident or claim
• Support underwriting, pricing and fraud-prevention activities
• Handle claims efficiently

We only share what is necessary for these purposes and require any insurer we share data with to handle it in accordance with applicable data protection law.

6. Our Legal Basis for Processing

We process telematics data on the following bases:

Performance of a contract

We process telematics data where this is necessary to provide and manage the hire vehicle and associated services.

Legitimate interests

We process telematics data where this is necessary for our legitimate interests and those of the insurer in managing risk, preventing fraud and resolving claims fairly.

We have assessed that these legitimate interests do not override your rights and freedoms.

Legal obligation

We may retain or disclose telematics data where we are required to do so to comply with the law or a court order.

7. How Long We Keep Telematics Data

We retain telematics data for as long as necessary to fulfil the purposes described in this Privacy Policy, including the duration of any related insurance claim, and in line with our data retention schedule.

Data is securely deleted once it is no longer needed.

8. Your Data Protection Rights

You have the right to request:

• Access to your telematics data
• Correction of inaccurate or incomplete data
